WARRANTY

6.1. The products sold by SPARCRAFT are guaranteed against any defect in material or workmanship for a period of one year from their delivery.

Under this warranty, SPARCRAFT's sole obligation will be the free repair or replacement of the product or element recognized by its services, to the exclusion of anye other indemnity or damages, any shipping costs being borne by the customer. Any coverage or intervention under the warranty must be subject to the prior written consent of SPRACRAFT. Defects and deterioration caused by natural wear and tear, by an external event (assembly not in accordance with SPARCRAFT's technical instructions, defective maintenance, abnormal or competitive use, force majeure, etc.) or by a modification of the product not provided for or specified by SPARCRAFT, are excluded from the warranty. Similarly, the warranty will not apply to apparent defects that the customer must invoke under the conditions of article 3.3.

6.2. Additional terms and conditions of sale and warranties for masts and adjustable rigging. Adjustable rigging and masts guyed by at least one element whose tension is adjustable by a "current" device, i.e. a hoist or a winch allowing long-stroke adjustments as opposed to a "standby" device, i.e. a turnbuckle, are the subject of selective use and the following reservations and imperative requirements: Unlike the "dormant" or "quasi-dormant" rigging, the tension allowed by the current element is left to the initiative of the crew during the navigation. Masts equipped with such a device may only be used and manoeuvred with caution and by an experienced crew. Excessive adjustments imposed during navigation inevitably lead to accelerated fatigue caused by inappropriate deformations and lead to either a risk of rupture or a risk of deformation, which itself will quickly lead to failure. These rigs and masts have no limitations to avoid excessive adjustments, they are designed and built to be maneuvered taking into account the technical characteristics of the aluminum alloy, excluding any excessive hangers with a higher boom value than the longitudinal dimension of the mast profile. Any use that does not comply with these strict special conditions will not be in accordance with the conditions of sale and will constitute a use contrary to that for which the rigging/mast assembly was designed, manufactured and sold.

6.3. This warranty is only applicable to the extent that the products sold by SPARCRAFT are used with the necessary precautions, under the conditions provided for above, and to the exclusion of all others, in particular regattas and competitions.

6.4. Place of warranty In the event of our acknowledgment that a repair or prevention has been taken as a guarantee, the intervention will take place exclusively at one of our authorized SPARCRAFT service points. The transport of the product to the service point remains the responsibility of the customer. The list of our many service points is available on request.

6.5. Legal warranty Under the warranty against hidden defects, SPARCRAFT will only be liable for the repair or replacement of the defective product to the exclusion of any other damage, the transport and installation costs remaining at the expense of the customer.

6.6. Obligations of the Customer The use of the Products as such or in combination with other products or goods shall be made to the following customers:isques and perils of the client. The customer undertakes to store and use the products in accordance with the regulations in force and to comply with all its legal obligations towards its own customers. SPARCRAFT cannot be held responsible for defects and deterioration of the products delivered as a result of abnormal or non-compliant conditions of storage, conservation and sales after the delivery of these products.

6.7. Exclusions The following are excluded from the guarantee specified in the articles above: – the costs of dismasting, masting, craneing, storage and transport of the mast (or other spar) and any spare parts. – Any costs and damages resulting from the impossibility of using the boat or its equipment, which in any case remain the responsibility of the buyer or user. – The deterioration or damage listed below as well as their consequences: normal wear and tear, cracks, cracks or discolouration of the paint or anodisation, damage resulting from: transformations and modifications, or even partial repairs carried out without authorisation from SPARCRAFT, failure to comply with the maintenance recommendations specified in the user manual delivered with the mast, failure to comply with the rules of the art, misuse, in particular negligent, reckless, abusive or abnormal use, participation in regattas, races, record attempts, negligence in taking the necessary precautionary measures, an accident or disaster such as explosion, fire, flood, storm, lightning, transport, riot, theft, collision, storage conditions or unsuitable transport.

6.8. Painted products Upon receipt of the products, they must be unpacked within 48 hours at most and stored properly. It is imperative to send a report of receipt of the product available with the delivery note or on our website. Without this acceptance report, we cannot assume any guarantee. Also excluded from the warranty are blisters and blisters that may appear on painted products, particularly around assemblies, fasteners and friction areas.

6.9. Force majeure In the event of the occurrence of a force majeure event, fortuitous event or external cause, in particular due to fires, floods, total or partial strikes, closures of companies, obstacles to travel, deliberate damage, theft, changes in regulations, impossibility of being supplied with raw materials, disruptions in energy supply, malfunction or interruption of electricity networks or telecommunications... SPARCRAFT will be released by operation of law and without compensation from its obligation to deliver from the date of occurrence of the events and undertakes to notify the customer as soon as possible.
